La palabra atenuante es de género femenino, pero en textos legales aparece frecuentemente "un atenuante" ¿No se debería decir una?

Respuesta: 

Atenuante puede ser sustantivo o adjetivo.En el primer caso es femenino. Como adjetivo, debe concordar con el género del sustantivo que está calificando: "el hecho atenuante", "la circunstanciaatenuante".
